The EEOC has implemented new nationwide procedures allowing for the release of a respondent’s position statement and non-confidential attachments to a charging party upon request during the investigation of a charge of discrimination. The charging party then has an opportunity to respond to the position statement. The response will not be provided to the respondent during the investigation. This applies to all requests for position statements after January 1, 2016.
